Terms of Service

These Terms of Service govern your access to and use of Kyvera, including the Discord bot, the web dashboard, API routes, server management features, moderation tools, feedback tools, automation features, Discord Gateway event processing, and related services.
1. Operator and Contact

If a separate legal notice or imprint exists on this website, the information listed there also applies to these Terms.
2. Acceptance of Terms
By inviting the Kyvera Discord bot to a server, logging into the dashboard, using commands, configuring features, enabling automations, or otherwise accessing the service, you agree to these Terms.
If you do not agree to these Terms, you must stop using the service, remove the bot from your Discord server, and stop accessing the dashboard.
3. Description of the Service
Kyvera provides tools for Discord communities, including but not limited to:
- server configuration and dashboard management;
- moderation, logging, warnings, tickets, and feedback tools;
- custom embeds, announcements, and automation features;
- server utility features, role/channel configuration, member management, and command handling;
- processing of Discord Gateway events and bot events required for enabled features;
- optional storage of server settings, logs, templates, and user-submitted content.
Features may be added, changed, limited, disabled, or removed at any time, especially when required for security, reliability, legal compliance, abuse prevention, or Discord platform compliance.
4. Relationship With Discord
Kyvera is an independent Discord bot and dashboard project. It is not owned, operated, endorsed, or officially certified by Discord unless explicitly stated otherwise.
Your use of Discord remains governed by Discord's own Terms of Service, Community Guidelines, Developer Terms, Developer Policy, and any other applicable Discord rules. You must not use Kyverain a way that violates Discord's rules or applicable law.
5. Eligibility and Authority
You may only use the dashboard and configure a Discord server if you have the necessary rights, permissions, or authorization to manage that server.
- You must not configure a server that you do not own or have permission to administer.
- You are responsible for actions taken through your Discord account, dashboard session, or authorized server permissions.
- If your Discord permissions are removed, your right to manage that server through Kyvera also ends.
6. Account Security and Login
The dashboard may use Discord OAuth2 login to identify you and verify your server permissions. You are responsible for keeping your Discord account secure.
- You must not share your dashboard session with unauthorized users.
- You must not attempt to bypass authentication or permission checks.
- If you believe your account or dashboard access has been compromised, you should revoke access through Discord and contact support.
7. Acceptable Use
You agree not to misuse Kyvera. Prohibited use includes, but is not limited to:
- using the bot or dashboard for spam, phishing, malware, scams, or fraud;
- using commands, embeds, announcements, automations, or logging features to harass, threaten, stalk, shame, or abuse others;
- coordinating raids, mass mentions, mass bans, mass DMs, or other disruptive activity;
- attempting to exploit, overload, reverse engineer, attack, scrape, or bypass the service;
- abusing bot permissions, Discord Gateway events, privileged intents, command handlers, or API routes for unauthorized monitoring, scraping, surveillance, or data harvesting;
- using backup, restore, moderation, role, channel, or automation features to intentionally damage a Discord server;
- uploading, storing, transmitting, or causing the bot to process illegal, harmful, abusive, or infringing content;
- violating Discord's Terms, Community Guidelines, Developer Terms, Developer Policy, or API rules;
- using the service in a way that violates applicable law or third-party rights.
8. Server Content and Administrator Responsibility
Server owners and administrators are responsible for the content, settings, commands, messages, logs, automations, permissions, channels, roles, and actions they create, configure, authorize, or enable through Kyvera.
We do not control how every Discord server configures or uses the bot. Server administrators are responsible for informing their users about moderation, logging, ticket, feedback, message processing, member-related features, presence-related features, or automation features enabled in their server where required by law or Discord rules.
9. Bot Permissions, Gateway Intents, and Potentially Destructive Actions
Some features may require elevated Discord permissions and Discord Gateway Intents, including privileged intents, where they are enabled and technically required for bot functionality.
These permissions and intents allow Kyvera to receive Discord events and perform actions needed for configured features such as moderation, logging, tickets, feedback, automation, member management, command handling, and server administration.
- You are responsible for reviewing permissions before inviting or configuring the bot.
- You should not grant permissions or enable features that are unnecessary for your server's use case.
- Features such as backups, restore actions, moderation commands, role changes, channel changes, logging, and automated actions may affect your server structure, content, or members.
- You are responsible for testing configurations before using them in important, large, or public servers.
- Details about what personal data and Discord event data may be processed are described in the Privacy Policy.
10. Moderation, Logs, Tickets, and Feedback
Kyvera may provide moderation logs, warning logs, audit-style logs, message logs, tickets, feedback submissions, transcripts, and administrative notes. These tools are provided for server management, safety, support, and troubleshooting purposes.
- Server staff are responsible for using moderation tools fairly, proportionately, and lawfully.
- Server staff are responsible for deciding which logging, transcript, message-related, member-related, or automation features are appropriate for their community.
- We are not responsible for disputes between server members and server staff.
- Feedback, tickets, logs, transcripts, and related metadata may be stored for support, security, moderation history, abuse prevention, and troubleshooting purposes as described in the Privacy Policy.
11. Backups and Restores
If backup or restore features are available, they are provided as a convenience tool and may not perfectly reproduce every server state, permission, integration, channel, role, message, webhook, or setting.
- You should review backup contents before restoring them.
- You should not restore backups you do not trust or understand.
- We are not responsible for accidental channel deletion, role changes, permission changes, data loss, moderation issues, or server disruption caused by backup or restore actions initiated by authorized users.
12. Service Availability
Kyvera is provided on an availability-best-effort basis. We do not guarantee uninterrupted uptime, error-free operation, or permanent availability of any feature.
The service may be temporarily unavailable due to maintenance, deployment changes, hosting issues, Discord API outages, Gateway disconnects, Discord rate limits, database issues, Cloudflare or Vercel issues, bot hosting issues, Supabase issues, network problems, or other technical problems.
13. Rate Limits and Abuse Protection
To protect the service, users, infrastructure, and Discord API access, we may apply rate limits, permission checks, anti-abuse systems, request filtering, IP-based protections, Cloudflare protections, Discord API restrictions, logging restrictions, or temporary access restrictions.
Attempts to bypass these systems may result in suspension, blacklisting, deletion of stored configuration, denial of dashboard access, removal of bot access, or permanent denial of service.
14. Privacy and Data Protection
Our processing of personal data, Discord account data, Discord server data, message-related data, member-related data, and technical data is described in the Privacy Policy.
By using Kyvera, you acknowledge that data may be processed as necessary to provide the service, authenticate users, verify permissions, operate configured bot features, maintain security, prevent abuse, and troubleshoot issues.

15. Third-Party Services
Kyvera depends on third-party services, including Discord, hosting providers, database providers, DNS/CDN/security providers, and deployment platforms. We are not responsible for outages, policy changes, data processing, limitations, API restrictions, Gateway changes, intent approval changes, or actions of third-party services outside our control.
If Discord, a hosting provider, a database provider, a security provider, or another third-party service changes its API, rules, pricing, availability, technical behavior, required approvals, Gateway behavior, or intent access, parts of Kyvera may stop working or need to be changed.
16. Intellectual Property
The name, branding, website design, source code, bot logic, dashboard UI, and related materials of Kyvera are owned by the operator or their respective rights holders unless stated otherwise.
You may not copy, resell, redistribute, reverse engineer, or create derivative commercial services from Kyvera without prior written permission, except where allowed by applicable law.
17. User Feedback and Suggestions
If you submit feedback, suggestions, bug reports, feature ideas, or similar content, you grant us permission to use that feedback to improve, modify, debug, secure, or develop Kyvera without requiring payment, credit, or approval, unless separately agreed in writing.
18. Paid Features
Unless explicitly stated otherwise, Kyvera is provided without paid subscription features. If paid features, premium access, donations, sponsorships, or commercial plans are introduced in the future, additional payment terms may apply.
Paid features, if introduced, may be changed, suspended, or discontinued subject to applicable law and any additional terms shown at the time of purchase.
19. Suspension, Termination, and Blacklisting
We may suspend, restrict, blacklist, or terminate access to Kyvera if we reasonably believe that:
- you violated these Terms;
- you violated Discord rules or applicable law;
- your server or account creates security, abuse, spam, privacy, compliance, or reliability risks;
- your use harms other users, Discord communities, our infrastructure, Discord API access, or the project;
- you abuse bot permissions, Gateway Intents, privileged intents, message content access, member data, or dashboard access;
- continued service access could expose us, users, Discord, or third parties to legal, technical, privacy, or security risk.
Suspension or blacklisting may apply to individual users, Discord accounts, guilds, IP addresses, tokens, sessions, or related identifiers.
20. Disclaimers
Kyverais provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties that the service will be uninterrupted, secure, error-free, accurate, complete, or suitable for a specific purpose.
You are responsible for reviewing settings, permissions, privileged intents, logging options, moderation rules, automations, and dashboard actions before using them in a live Discord server.
21. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of server configuration, loss of reputation, loss of profits, service interruption, Discord account issues, moderation disputes, incorrect logs, missing logs, false moderation actions, Gateway event issues, API rate limits, or third-party actions.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory statutory rights.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the operator of Kyvera from claims, damages, losses, liabilities, costs, or expenses arising from your misuse of the service, your server configuration, your use of bot permissions or Gateway Intents, your violation of these Terms, your violation of Discord rules, your violation of applicable law, or your infringement of third-party rights.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in the service, Discord requirements, infrastructure, Gateway Intents, bot permissions, security practices, legal requirements, or operational needs.
The latest version will be available on this page. Continued use of Kyvera after changes become effective means that you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the service and remove the bot from your server.
24. Governing Law
These Terms are governed by the laws of Germany, unless mandatory consumer protection laws or other mandatory legal provisions require otherwise.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions remain in effect. The invalid provision will be replaced by a valid provision that most closely reflects the original purpose, to the extent permitted by law.
